South Korea’s Constitutional Court ruled on Monday to overturn the impeachment of Prime Minister Han Duck-soo, immediately reinstating him to office. Of the nine-member court, five justices rejected the motion, while one upheld it and two supported dismissal.
Han was impeached by the opposition-controlled National Assembly on December 27, following the impeachment of President Yoon Suk-yeol on December 14 over his failed martial law imposition. During their absence, Economy and Finance Minister Choi Sang-mok served as acting president.
The court acknowledged that Han’s refusal to appoint constitutional court justices was unconstitutional but found no evidence linking him to Yoon’s martial law imposition. As a result, his impeachment was deemed unjustified, leading to his reinstatement.
