Colorado judge finds Trump engaged in ‘insurrection’ but allows him on ballot

A Colorado judge ruled that Donald Trump can remain on the state’s ballot in the upcoming election but found that he “engaged in insurrection” by inciting the January 6, 2021, attack on the U.S. Capitol. The judge rejected a bid by Colorado voters to disqualify Trump under a rarely used constitutional amendment barring officials who have engaged in insurrection from holding federal office. The judge determined that, as president, Trump was not an “officer of the United States” subject to disqualification under the amendment. While a victory for Trump, the judge concluded that Trump’s words were a substantial factor in the Capitol attack. The case, viewed as a test for wider disqualification efforts, is likely to be appealed.
