Elon Musk is seeking up to $134 billion in damages from OpenAI and Microsoft, claiming he is entitled to the “wrongful gains” generated from his early support of OpenAI, according to a court filing reported by Reuters. Musk argues that OpenAI gained between $65.5 billion and $109.4 billion from his contributions as a co-founder, while Microsoft earned between $13.3 billion and $25.1 billion through its partnership with the company.
Musk, who left OpenAI in 2018 and now runs rival AI firm xAI, alleges that OpenAI abandoned its original nonprofit mission by restructuring into a for-profit entity. OpenAI dismissed the claim as an “unserious demand” and part of a harassment campaign, while Microsoft denied wrongdoing. Both companies challenged Musk’s damages calculations, calling his expert’s analysis unreliable and misleading. A U.S. judge has ruled the case will go to a jury, with the trial expected to begin in April.
